The legal basis and penalties are as follows:
Anyone is prohibited from manufacturing, importing, selling (including through the Internet, physical stores and face-to-face transactions), supplying (providing others with use), displaying or advertising (making advertisements, accepting dissemination or publishing) various electronic cigarettes or their combination components. The relevant penalties are as follows:
1. If a manufacturer or importer manufactures, imports or advertises, a fine of NT$10 million to NT$50 million shall be imposed; if a person other than a manufacturer or importer manufactures or imports, a fine of NT$50,000 to NT$5 million shall be imposed.
2. If an advertising industry or media industry produces advertisements, accepts dissemination or publications, a fine of NT$400,000 to NT$2 million shall be imposed; if a person other than a manufacturing industry, import industry, advertising industry, media industry or advertising client imposes a fine of NT$200,000 to NT$1 million.
3. Selling or displaying tobacco products or their components will be fined between NT$200,000 and NT$1,000,000.
4. Supplying tobacco products or their components will be fined between NT$10,000 and NT$250,000.
5. Using tobacco products (e.g., electronic cigarettes) will be fined between NT$2,000 and NT$10,000.
